AerClub Terms and Conditions

Effective from 01 March 2024, these AerClub Terms and Conditions (together with, where relevant, the AGL Conditions of Use) set out below are important and affect your rights as a Member of AerClub.


You must read both these AerClub Terms and Conditions and the terms and conditions on aerlingus.com which are identified in these Terms and Conditions (including the Privacy Statement, Conditions of Contract and Conditions of Carriage) carefully before first quoting your Membership Number to Aer Lingus or an AerClub Airline Partner or Service Partner. These AerClub Terms and Conditions contain some exclusions and limitations of liability with which we recommend you familiarise yourself.

1. Membership agreement

These AerClub Terms and Conditions set out the contractual relationship between Aer Lingus, AGL and each individual Member of AerClub.

AGL is a member of International Airlines Group; AGL owns and manages the Avios currency and its role in this contract relates primarily to the awarding of Avios, the redemption of Avios and to clarify that title in Avios is held by AGL in accordance with Clauses 10.1, 11.1 and 13.1. As a result, AGL will receive, store and otherwise process and hold specific Member Data solely in connection with administering aspects of the AerClub programme as set out in these Terms and Conditions. In this respect, AGL is a Data Controller, and Aer Lingus is also a Data Controller (in each case as defined by applicable data protection legislation, currently the Data Protection Act 2018 in Ireland). Please note that although AGL and Aer Lingus are each a Data Controller in respect of Members' Data, they are independent Data Controllers, each with their own responsibilities for separate aspects of the data processing involved in administering AerClub.

AGL is also a party to the terms in this Agreement where they are specifically referenced.


Definitions

In these AerClub Terms and Conditions unless the context requires otherwise:

"AGL Conditions of Use" means the AGL conditions of use which can be found at https://rewards.aerlingus.com/terms-and-conditions

"AerClub" means the loyalty programme called AerClub operated by Aer Lingus;

"AerClub Airline Partners" means airlines (otherthan Aer Lingus) whose flights may be eligible for earning and/or redeeming Avios from time to time as specified on the website at https://www.aerlingus.com/aerclub;

"Aer Lingus" means Aer Lingus Ltd;

"Aer Lingus Group" means any company in the International Airlines Group;

"aerlingus.com" means the Aer Lingus website at www.aerlingus.com;

"AGL" means Avios Group (AGL) Limited;

"AerClub Anniversary Date" is the day and month in which the Member registered their details with AerClub;

"AerClub Qualification Period" means the twelve-month period between 01 April and 31 March each year;

"Avios" means the credits (and each unit thereof) denominated as "Avios" or "Avios points" earned by a Member from AGL and credited to a Member's AerClub account;

"Card" means, where issued, a Silver, Platinum or Concierge digital membership card, as the case may be;

"Co-branded Credit Card" means, where applicable, a credit card issued by a bank in conjunction with AerClub;

"Concierge" means the highest Tier Membership level;

"Data" means personal data of a Member;

"Event Beyond Your Control" means unusual and unforeseeable circumstances which you cannot control and the consequences of which you could not have avoided even if you had taken all reasonable care:

"Fraud" includes fraud, dishonesty and deceit and in particular, a Member:

"Green" means the basic or lowest Tier Membership level;

"International Airlines Group" means International Consolidated Airlines Group, S.A.;

"Loss" means losses, costs, damages, injuries, accidents or claims (whether direct or indirect) suffered by Members in connection with the provision of Services or Rewards;

"Lounge" means an Aer Lingus-operated airport lounge provided for Members;

"Marketing Partners" means Service Partners, franchisees, subsidiaries of Aer Lingus and any company engaged by Aer Lingus to offer services, products or facilities to Members;

"Member" means the person who is a member of AerClub;

"Membership" means membership of AerClub;

"Membership Number" means the membership number allocated in accordance with Clause 2.5 of the AerClub Terms and Conditions;

"Misconduct" includes:

"Non-Flight Rewards" means any Rewards comprising, in whole or in part, goods or services other than flights supplied by or on behalf of Aer Lingus upon redemption by a Member of an appropriate part of the Member's Avios;

"Platinum" mean the second highest Tier Membership level;

"Processing" and "Processed" includes obtaining, using, recording and holding in electronic or any other form;

"Rewards" mean: (a) a reward flight ticket issued by Aer Lingus or AerClub Airline Partner; and/or (b) upgrades on Aer Lingus flights or other goods; and/or (c) services available from time to time in each case upon redemption by a Member of an appropriate part of the Member's total Avios;

"Sector" means a single eligible flight sector between two destinations;

"Service Partner" means partners (including AerClub Airline Partners) and companies including but not limited to financial and insurance institutions, hotels and car hire companies, that provide Services to Members by reason of their Membership;

"Services" means Tier Benefits, services, Rewards, Non-Flight Rewards and any other benefits, goods or services from time to time available to Members;

"Silver" means the second Tier Membership level;

"Tier" means one of the four Membership Tiers of Green, Silver, Platinum or Concierge, as determined by the Tier Credits earned by the Member in the course of a single AerClub Qualification Period;

"Tier Benefits" means the different combinations of loyalty recognition benefits applicable from time to time for each of the Tier levels;

"Tier Credits" means the credits that may be awarded to the Member from time to time as set out on the AerClub website https://www.aerlingus.com/aerclub/using-aerclub/tiers-and-benefits/.

2. Membership

2.1

Individuals who are 18 years of age or over may apply for Membership. For the avoidance of doubt Membership is not available to individuals under the age of 18 years.

2.1.1

Aer Lingus reserves the right not to enrol individuals with resident addresses in certain countries and/or regions. Such countries and/or regions are subject to change, however reasonable advance notice will be given in circumstances where the removal of a country and/or region will affect the Membership of an existing Member.

2.2

Membership is not open to companies, partnerships, unincorporated associations or similar entities.

2.3

To apply for Membership an individual must apply online at https://www.aerlingus.com/aerclub/. Eligibility for membership is determined by the applicant's country of residence and local rules or restrictions relating to the Services and eligibility for local promotions or the Services may apply.

2.4

Membership is offered at the discretion of Aer Lingus and Aer Lingus may refuse Membership to any applicant.

2.5

Applicants accepted as Members will be given a Membership Number and provided with digital membership. Multiple Membership by a single individual is not permitted and each Member must maintain only one Membership account. In the case of duplication of Membership, all Memberships (other than the first Membership approved by Aer Lingus) will be cancelled as will any duplicate Avios.

2.6

Applicants will be admitted to Membership on the date they activate their account by confirming their email address via https://www.aerlingus.com/html/login.html. By activating their account via https://www.aerlingus.com/aerclub/; using digital membership, providing their Membership Number and/or participating in the AerClub, Members agree to be bound by these Terms and Conditions (as amended from time to time), and the information on the AerClub website https://www.aerlingus.com/aerclub/ and on other areas of our website as identified in these Terms and Conditions.

2.7

Each Member must give Aer Lingus written notice as soon as practicable of any changes of name or preferred postal or email address and, if requested by Aer Lingus, written proof of any such changes. Certain changes can be made online by visiting https://www.aerlingus.com/aerclub/members-area/. Aer Lingus accepts no liability for Loss arising from failure to award Avios and/or Tier Credits to the Member arising from incorrect personal details being supplied.

2.8

Correspondence will be sent to the e-mail address provided on application or any other address properly notified to AerClub in accordance with Section 2.7. Aer Lingus and AGL each reserves the right to provide certain information, including changes to the AerClub programme, only to active Members. An active Member is a Member who has earned or redeemed Avios within the previous 12-month period. Inactive Members will continue to be able to access their account details and other information from time to time by visiting https://www.aerlingus.com/aerclub/members-area/.

2.9

Neither Aer Lingus nor AGL will be responsible for late, lost or misdirected mail.

2.10

Correspondence from Members to Aer Lingus should be sent to AerClub, Aer Lingus, Dublin Airport, Co. Dublin.

2.11

Membership will terminate automatically in the following circumstances:

2.11.1

iin the event of the expiry of all Avios in accordance with Clause 10.6 (i.e. expiry of all Avios earned up to that date when a Member has not earned, redeemed, purchased or transferred Avios in accordance with the AGL conditions of Use for 36 consecutive months and

2.11.2

upon the death of a Member, in which case all Avios and Tier Credits accumulated but unused at the time of death shall be cancelled.

2.12

A member may nominate another individual to act on their behalf in relation to their Membership and must complete an authorisation form (see https://www.aerlingus.com/media/pdfs/AerClub-Third-Party-Authorisation-Form.pdf. Nominations must be made in accordance with the procedures set out on the AerClub website at https://www.aerlingus.com/aerclub/about-aerclub/faqs/. A nominated individual will be able to (a) check the Member's Avios and Tier Credits, flight tracking; and (b) change meal or seat preferences; and (c) make redemption bookings. The Member is responsible for the actions of the nominated individual. The Member is responsible for ensuring any nomination is updated as necessary.


2.13

AerClub is not a members' or proprietors' club.


3. Protection of Members' Data

3.1

Please refer to the Aer Lingus Privacy Statement for full details of how we protect Members' Data, https://www.aerlingus.com/support/legal/privacy-statement/.

3.2

Aer Lingus and/or AGL may disclose Data relating to a Member to a third party who has been nominated by the Member in accordance with Clause 2.12. Members are responsible for the security of their online usernames and passwords and neither Aer Lingus nor AGL shall have any liability in the event that a Member's logon and/or password is disclosed by the Member, whether intentionally or not, so as to allow a third party online access to the Data and to make any transactions. Aer Lingus and AGL reserves the right to block online access to the Data by or through any third party website not authorised by Aer Lingus or AGL.


4.Use of the digital membership

4.1

Silver, Platinum and Concierge Tier Members will be eligible to receive a digital membership upon earning a set level of Tier Credits. Digital membership and tier expiry date will be available on a Member's AerClub profile which can be accessed on aerlingus.com or on the Aer Lingus app.

4.2

Digital membership is personal to the Member. Only the Member named on may use it to access Tier Benefits or Services. Digital membership is not transferable in any circumstances.

4.3

The Member should produce their digital membership status or Membership Number at any time whilst travelling or otherwise utilising any Services at the request of Aer Lingus or a Service Partner. Members should add their Membership Number to all bookings at time of booking, or prior to their flight when checking-in online or at the airport to assist in ensuring any Avios/Tier Benefits earned in respect of the booking are credited to their Member account.


5. Recognition: AerClub Tiers & Tier Credits

5.1

The Membership Tier is determined by the amount of Tier Credits earned by the Member in the AerClub Qualification Period. The Qualification Period begins on 01 April and ends on 31 March. Tier Credits are earned from travel on eligible Sectors, fares and flights and as set out on the AerClub website, https://www.aerlingus.com/aerclub/tier-programme/tier-benefits/.

5.2

Tier Benefits are determined by the number of Tier Credits earned and recorded during the AerClub Qualification Period. Tier Credits will be earned only after the Member has flown the eligible Sector (except as provided in Clause 5.14 below) and can only be counted once. A Member's Tier status will be reviewed on 31 March each year, in advance of the Member's Tier Credits resetting to zero on the 01 April.

5.3

Tier Credits will be credited only to the Member who has travelled on the flight on the relevant Sector and not to any third party (including any travelling companion(s)). If a Member makes a booking for a travelling companion, that companion may earn Tier Credits if the companion is also a Member and their Membership Number is added to the booking.

5.4

In order to advance to the next Membership Tier, in addition to acquiring the stipulated number of Tier Credits notified to Members via the AerClub website from time to time, a Member is required to travel on a minimum of two Sectors operated and ticketed by Aer Lingus for each Tier level during the AerClub Qualification Period. For example, to achieve or retain Platinum Tier status, a Member must have flown on at least four Sectors operated and ticketed by Aer Lingus during the AerClub Qualification Period.

5.5

Aer Lingus may at its discretion downgrade the Member's Tier level if they have not earned the required Tier Credits or travelled on the required number of Sectors in the AerClub Qualification Period. Tier Credits earned prior to the beginning of the relevant AerClub Qualification Period will not be counted for this purpose.

5.6

If the Member has advanced to a new Tier in the current AerClub Qualification Period they will remain in that Tier for the remainder of that AerClub Qualification Period as well as for the duration of the next AerClub Qualification Period (unless the Member achieves a higher Tier status during that time in which case the same time periods apply for the higher Tier status i.e. for the remainder of the then current AerClub Qualification Period plus the next AerClub Qualification Period).

5.7

Aer Lingus may, from time to time, alter the rules for earning Tier Credits, for example, by altering eligible flights or fares or the number of Tier Credits earned for specific Sectors. Members will be notified of any changes on the AerClub website.

5.8

Members must provide their full name (which must match exactly the name and spelling on their passport) and Membership Number for flights to be counted for Tier Credits.

5.9

The rules for earning Tier Credits may be different from the rules for earning Avios. For information on how to collect Avios see https://www.aerlingus.com/aerclub/using-aerclub/collecting-avios/.

5.10

Only individual Members are eligible to earn Tier Credits and Tier Credits are not transferable. Members should allow up to six weeks for Tier Credits earned on eligible Aer Lingus flights to be awarded and longer for Tier Credits earned on eligible flights with AerClub Airline Partners where applicable.

5.11

Each Member is responsible for checking that Tier Credits have been properly credited to the Member's account. This can be checked online at https://www.aerlingus.com/aerclub/members-area/. Tier Credits are not awarded on Redemption flights booked using Avios.

5.12

Tier Credits which for any reason are not tracked at the time of travel may be credited later at Aer Lingus' discretion. Members may submit a request to claim Tier Credits after completion of their travel either online at https://www.aerlingusaerclub.com/index.aspx or if required, by submitting the retained segment of the boarding pass and passenger receipts, provided that flight is eligible i.e. the Member was registered with AerClub at the time of travel and the claim is made within 3 months of the date of travel or the relevant transaction. A new Member may not claim Tier Credits for flights taken prior to the commencement of their Membership.

5.13

Where a Member is involuntarily re-routed by Aer Lingus onto another carrier for any reason, and the original flight on which the Member was booked would have qualified for Tier Credits, the Member may still claim such Tier Credits. AerClub will endeavour to ensure the Member's AerClub account is credited with the appropriate Tier Credits. It may be necessary for details of the Member's itinerary, including the retained segment of the boarding pass and passenger receipts to be sent to AerClub, at Aer Lingus, Dublin Airport, Co Dublin, in order to claim Tier Credits.

5.14

Travel on agency discount tickets, industry discount tickets and/or airline employee discount tickets is not eligible for Tier Credits. Travel on Rewards tickets is not eligible to earn Tier Credits. Travel on infant fares is not eligible for Tier Credits. Upgrades purchased on the day of travel at the airport and upgrades that have been purchased using the 'Upgrade Yourself' bidding process only the original booking element of the fare is eligible for Tier Credits; the upgrade element of the fare is not eligible for Tier Credits.

5.15

In the event of a dispute about entitlement to Tier Credits, Aer Lingus may require proof of travel including the retained segment of the boarding pass and passenger receipts for the Sector claimed to have been flown. Claims must be lodged within 6 months of the date of travel.

5.16

Members can apply for their status to be extended due to the birth/adoption of a new baby or due to serious illness if they are Silver, Platinum or Concierge status. Members who have received complimentary status are not eligible.

In order to qualify, Members will need to provide a letter from their doctor, a birth certificate or documentation relating to the birth/adoption (within 6 months of the birth/adoption of the baby) or serious illness (certified by a doctor that you are unable to fly for a minimum of 16 weeks) and send it to aerclubassist@aerlingus.com. Where a couple adopt jointly, the couple must choose which partner takes adoption leave.

Eligible Members are limited to a maximum of two approved applications within a five year period.

Eligible Members can continue to collect Tier Credits and Avios and enjoy their current tier benefits to the extended date. No new benefits will be awarded in the extended period.

Should a Member qualify for a higher Tier during the extension period this will be honoured and the extension on your previous Tier will come to an end.

Tier Extension is a discretionary benefit. Aer Lingus reserves the right to require any reasonable form of evidence or identification to validate an application and reserves the right to decline the application and to change or withdraw this benefit at any time.


6. Lounges

6.1

Lounge access is available only to Silver, Platinum and Concierge digital membership Card holders (and a companion where applicable). The Lounges that Members have access to will vary depending on their Membership Tier status. Please see the AerClub website for details https://www.aerlingus.com/travel-information/airport-information/airport-lounges/. Lounge access is subject to availability.

6.2

To access a Lounge, Silver, Platinum and Concierge digital members must present their valid AerClub digital membership along with their Aer Lingus boarding card.

6.3

If a Member is unable to produce these items, this may result in the Member being refused access to the Lounge. Anyone under the age of 18 years must be accompanied by a responsible adult when using a Lounge. Local laws relating to the consumption of alcohol will apply.

7. Services provided by Service Partners

7.1

Some Services (such as certain Lounges) may be provided by Aer Lingus and others (such as car hire and certain Lounges) by Service Partners. Aer Lingus will use reasonable endeavours to ensure the availability of Services provided by Service Partners but will not be liable for any Loss arising from failure by Service Partners to provide such Services.

7.2

The provision of Services by Aer Lingus and Service Partners is conditional on Members providing the information requested at the time of booking the Service and, where appropriate, producing their digital membership and providing additional information as may be reasonably required by the Service Partner.

7.3

Where a Member uses Services which are not provided by Aer Lingus, the Service Partner's terms and conditions relating to such Services will apply including those terms and conditions relating to bookings, ticketing, passports and all other matters, and Aer Lingus will not be liable for any Loss in relation thereto or arising therefrom.

7.4

Aer Lingus may discontinue relationships with Service Partners at any time and will notify Members of any discontinuance on the AerClub website.


8. Members eligible for Avios

8.1

Only individual Members are eligible to earn Avios. Each Member must provide their full name (which must match exactly the name and spelling on their passport) and Membership Number in order to collect Avios from Aer Lingus or Service Partners.

8.2

Members are not entitled to earn Avios if the name given at the time of booking does not match exactly the name on their AerClub account or if they have given incomplete information when booking.

8.3

Each Member is responsible for checking that Avios have been properly credited to the Member's account. This can be checked online at https://www.aerlingus.com/aerclub/members-area/. Avios are not awarded on Redemption Flights booked using Avios.

8.4

It can take up to ninety working days for Avios to be credited to the Members' AerClub account.


9. Flights eligible for Avios

9.1

Avios can only be earned for travel on eligible Sectors in eligible booking classes on either Aer Lingus or selected AerClub Airline Partner flights. Details are set out on https://www.aerlingus.com/aerclub/. Any changes to the criteria for earning Avios will be notified to Members through the AerClub website.

9.2

Aer Lingus may, from time to time, communicate the criteria for earning Avios on flights, which may include:

9.2.1

the identity of the airline (that is, Aer Lingus or an AerClub Airline Partner);

9.2.2

eligible Sectors;

9.2.3

eligible regions;

9.2.4

eligible fare families;

9.2.5

eligible cabin classes; and

9.2.6

eligible booking classes.

9.3

Agency discount tickets, industry discount tickets and/or airline employee discount tickets are not eligible for Avios. Travel on Rewards tickets is not eligible to earn Avios. Tier Credits are not relevant to the calculation of Avios. Infant fares are not eligible for Avios. Upgrades purchased on the day of travel at the airport and upgrades that have been purchased using the 'Upgrade Yourself' bidding process only the original booking element of the fare is eligible for Avios; the upgrade element of the fare is not eligible for Avios.


10. About Avios

10.1

Avios are earned by the Member in return for activity with Aer Lingus and Service Partners. The methods to earn those Avios are set out in the remainder of this Clause 10.

10.2

Avios will be earned on Aer Lingus flights only after the Member has flown the Sector (except as provided in Clause 10.7 below) and will be awarded on the basis of fare spend (excluding taxes, fees and charges, and any ancillary retail spend, unless included as part of a targeted promotion).

10.3

Avios can be earned on selected AerClub Airline Partners and is calculated based on distance flown (between the ticketed points of origin and departure) and fare class.

10.4

For travel on connecting flights that includes flights with both Aer Lingus and an AerClub Airline Partner, the number of Avios is calculated in accordance with Clauses 10.2 and 10.3 above for each separate eligible Sector of the trip.

10.5

Avios can only be earned once per Sector per Member, regardless of the number of seats purchased. Avios will be credited only to the Member who has travelled on the flight on the relevant Sector and not to any third party (including any travelling companion(s)). If a Member makes a booking for a travelling companion, that companion may earn Avios if they are also a Member and their Membership Number is added to the booking.

10.6

If a Member has not earned, redeemed, purchased or transferred Avios for 36 consecutive months, all Avios that have been earned up to that date will expire and the Membership will automatically terminate in accordance with Clause 2.11.1 (combine my Avios transactions do not constitute earning, redeeming, purchasing or transferring of Avios).

10.7

Where a Member is involuntarily re-routed by Aer Lingus onto another carrier for any reason, and the original flight on which the Member was booked would have qualified for Avios, the Member may still claim such Avios. Aer Lingus will endeavour to ensure the Member's AerClub account is credited with the appropriate Avios. It may be necessary for details of the Member's itinerary, including the retained segment of the boarding pass and passenger receipts to be sent to AerClub at Aer Lingus, Dublin Airport, Co Dublin, in order to claim any Avios.

10.8

Other than in relation to special promotions notified to Members from time to time Aer Lingus does not permit earning of Avios where a Member is earning credits within another loyalty programme in respect of the same Services. Aer Lingus is entitled to deduct from the Member's account any Avios earned in this way.

10.9

Aer Lingus will record Avios earned in the Member's AerClub account. Avios cannot be redeemed until Aer Lingus has recorded them in the Member's AerClub account.

10.10

Avios which are not tracked automatically at the time of travel may be credited later at Aer Lingus' discretion. Members may submit a request to claim Avios after completion of their travel either online at https://www.aerlingusaerclub.com/index.aspx or if required, by submitting the retained segment of the boarding pass and passenger receipts, provided that flight is eligible i.e. the Member was registered with AerClub at the time of travel the member can claim within 6 months of the travel date, the Member joined AerClub within 3 months of travel date, the claim must be made within 3 months of the travel date. A new Member may claim Avios for eligible Aer Lingus flights taken up to 3 months prior to the commencement of their Membership.

10.11

In the event of a dispute about entitlement to Avios, Aer Lingus may require proof of travel including the retained segment of the boarding pass and passenger receipts for the Sector claimed to have been flown. Claims must be lodged within 6 months of the date of travel.

10.12

When a Member enters into a transaction with a Service Partner they may be entitled to earn Avios or other Services provided they quote their Membership Number when entering into the transaction and, if required, present their digital membership or Membership Number on request. In some cases a Member may be required to enrol in the loyalty programme of a Service Partner and convert the Service Partner's loyalty credits into Avios at the Member's option. Where a Member must elect whether to earn either Avios or the Service Partner's loyalty credits the Member will not be permitted to re-elect or reverse the Avios transaction at a later date.

10.13

Service Partners which offer Services or the ability to earn Avios to Members are listed on the AerClub website https://www.aerlingus.com/aerclub/using-aerclub/collecting-avios.

10.14

In order for flights to be counted for Avios, the Member must provide their full name (which must match exactly the name and spelling on their passport) and Membership Number online or to the reservations agent/travel agent each time a booking is made for travel on Aer Lingus or when using any other Services. A Member may also present their AerClub digital membership Card at check-in. Failure to give complete information may result in earned Avios not being credited to the Member's account and the Member not receiving certain Services.

10.15

If your booking is cancelled, or not flown no Avios will be awarded.


11. Redeeming Avios

Avios may be redeemed by Members for Rewards provided by Aer Lingus and Service Partners. Avios are redeemed with AGL. The methods available to Members to redeem their Avios and access Rewards are set out in the AGL Conditions of Use - Using Rewards, https://rewards.aerlingus.com/terms-and-conditions. Rewards may vary depending on the country in which the Member is resident. For details see the AGL Conditions of Use https://rewards.aerlingus.com/terms-and-conditions.


12. General

12.1

From time to time, Aer Lingus and AGL may offer special promotional rates for earning Avios and/or redeeming Rewards and such promotions will be subject to the terms and conditions as published with each offer and which take precedence over these AerClub Terms and Conditions. Unless otherwise permitted by Aer Lingus, Rewards (including special promotional Rewards and/or upgrades) may not be used in conjunction with other awards, promotions, coupons, discounts or special offers.

12.2

Rewards are not redeemable for cash, refundable (other than as provided for in the AGL Conditions of Use) or exchangeable for any other tickets or anything else and may be cancelled in such circumstances. At no time may Rewards be purchased by, sold to, bartered or otherwise transferred to any other person.

12.3

It is the Member's responsibility to ensure that they and everyone with whom they are travelling or any third party in whose name a Reward has been issued:

12.3.1

has checked the relevant entry requirements for any country being visited; and

12.3.2

has the correct passports, visas, health certificates and other travel documents needed for the journey.

Members, travel companions or third parties in whose name a Reward has been issued, may be denied boarding if their documents are not in order. Aer Lingus shall not be liable for any Loss suffered by a Member and/or any other person as a result of their failure to arrange any of the above.

12.4

Aer Lingus and AGL reserves the right to audit a Member's account and records without notice to the Member to check for compliance with these AerClub terms and conditions, the Aer Lingus General Conditions of Carriage and Conditions of Contract and any other applicable laws, rules, regulations or terms and conditions. During an audit if unusual activity is detected, or if Aer Lingus or AGL determine that there are reasonable grounds for so doing (including to protect a Member's account from Fraud) a Member may be unable to redeem their Avios or make Reward bookings pursuant to the AGL Conditions of Use

12.5

AerClub members can request to upgrade an existing Aer Lingus non-reward flight (booked through www.aerlingus.com or the Aer Lingus app) using either Avios or by redeeming a complimentary Upgrade benefit. Upgrades are granted subject to AerClub availability and cannot be guaranteed. Advanced upgrade availability will not be provided.

Once confirmed, upgrades are non-transferable and non- refundable.

Fare rules applicable to the original fare continue to apply to the upgraded booking and any seat or bag fees paid on the original fare remain non-refundable.

Tier Credits and Avios will be awarded to the members AerClub account based on the original economy fare booked.


13. Ownership of Avios

13.1

Avios, and all rights of title to and property in such Avios issued at any time, remains with AGL at all times and never passes to the Member.

13.2

Risk (for example, theft or unauthorised or fraudulent redemption) associated with Avios passes to the Member as soon as Avios is recorded on the Member's account, or otherwise awarded to the Member. Neither AGL nor Aer Lingus is liable for unauthorised or fraudulent redemptions arising due to the actions of the Member or the failure by the Member to adhere to these AerClub Terms and Conditions.


14. Non-transferability of Avios

14.1

Except as otherwise provided by Aer Lingus and/or AGL Conditions of Use and communicated to the Member, Avios are not transferable (whether from person to person, to the account of another member, statement to statement, digital membership to digital membership or otherwise) and cannot be bequeathed, devised or otherwise transferred by operation of law.

14.2

Any purported purchase, sale, transfer, unauthorised use (including bartering), procurement or redemption of Avios issued or awarded to another person or any other use of Avios contrary to these Terms and Conditions is void and will constitute a fundamental breach by the Member of these Terms and Conditions and therefore the contract between Aer Lingus, AGL and the Member.

14.3

Each Member acknowledges that a breach pursuant to Clause 14.2 above may also constitute an inducement to breach the contract between Aer Lingus, AGL and the Member, intentional damage to the business of Aer Lingus and/or AGL, conspiracy and criminal offences under applicable local or national law. Any breach pursuant to Clause 14.2 will constitute Fraud and/or Misconduct and will be dealt with in accordance with Clause 16.


15. Member's right to terminate Membership

Members may terminate their Membership at any time by contacting AerClub online by completing this form and clicking “AerClub/Frequent flyer” and “Delete my account” from the drop down lists under the “How can we help?” section. Any such termination will result in a loss of all Avios and does not relieve the Member of any continuing obligations under these AerClub Terms and Conditions. 16. Aer Lingus' right to suspend or terminate Membership

16.1

In addition to any other rights or remedies it may have, Aer Lingus reserves the right at any time, in its absolute discretion, to suspend or terminate the Membership of any Member and/or (if applicable) the right of any Member to use the digital membership if a Member commits Fraud, Misconduct, or is given a ban notice. Aer Lingus will contact such Member stating their Membership is being suspended or terminated and the reason for same. Aer Lingus may additionally or in the alternative in its discretion suspend such termination and impose a reduction in Tier grade and/or remove Avios and/or Tier Credits and/or request undertakings in respect of future conduct. AGL may additionally or in the alternative in its discretion suspend such termination and/or remove Avios and/or request undertakings in respect of future conduct.

16.2

In the case of Fraud and/or Misconduct, Aer Lingus and/or AGL may cancel all accrued and accruing Avios and/or Tier Credits and/or Tier status of the Member and any Rewards.

16.3

The Member shall be liable to Aer Lingus and/or any AerClub Airline Partner for the full price of any travel undertaken on Reward tickets, wholly or partly as a result of such Fraud and/or Misconduct, in accordance with the published fare applicable to such travel together with any reasonable costs, including legal fees, incurred by Aer Lingus.

16.4

In the event of the termination of Membership, the Member's digital membership will be rendered null and void. In the event an individual continues to hold a Co-branded Credit Card post termination of Membership that individual will no longer be entitled to receive any Avios or Services arising from use of the Co-branded Credit Card.

17. Termination of AerClub

Aer Lingus may terminate AerClub and/or Avios and/or Tier Credits at any time. Except in the event of insolvency (in which case no notice is required), Aer Lingus will use its reasonable endeavours to give at least six months' notice to Members. In the event of insolvency of Aer Lingus, or otherwise on termination at expiry of the period of notice (if any), each Member acknowledges and agrees that their right to use the Services (including the earning and redemption of Tier Credits with Aer Lingus and Avios with AGL) will cease with immediate effect.


18. Modification or withdrawal of the AerClub services

18.1

Aer Lingus and/or AGL may modify, withdraw, amend or add to any Services or other offers or arrangements or impose any requirements or restrictions relating to the use of Services. Aer Lingus and/or AGL will give as much advance notice as practicable of such action to Members. Current information is set out on aerlingus.com. In addition, Service Partners reserve similar rights to withdraw, amend or add to Services or impose requirements or restrictions relating to them.

18.2

Examples of the action which Aer Lingus and AGL might take under Clause 18.1. include withdrawing Services which Aer Lingus provides itself (such as certain Lounges), modifying the right to earn or redeem Avios, the withdrawal of a Service (such as car hire and/or certain Lounges) provided by a Service Partner or the withdrawal of Rewards.

18.3

Members shall be deemed to have agreed to any modifications, withdrawal, amendment or addition to the Services or the AerClub programme pursuant to Clause 18.1 if, after they have been notified of the changes, they continue to quote their Membership Number to obtain Services. Members who do not wish to accept changes in the Services may terminate their Membership in the manner described in Clause 15.


19. Variation of currency

Aer Lingus and/or AGL may, from time to time, change the currency used by AerClub either as a whole or in relation to any country or region. Aer Lingus will use its reasonable endeavours to give at least six months' notice to Members of any such changes.


20. Variation of these AerClub Terms and Conditions

Each of Aer Lingus and AGL reserves the right at all times to make any changes to these AerClub Terms and Conditions, subject to giving Members reasonable notice as appropriate in the circumstances (including for the avoidance of doubt via a notification of change of terms on the AerClub section of aerlingus.com at https://www.aerlingus.com/aerclub/about-aerclub/faqs/). By continuing to use the AerClub programme following any such notice (or notification) a Member is deemed to have accepted the revised Terms & Conditions. Members who do not accept the amendments may terminate their Membership as described in Clause 15.


21. Exclusion of liability

21.1

Except for any liability that cannot be lawfully limited or excluded, neither Aer Lingus nor AGL will be liable for any Loss or any liability of any sort (including, without limitation, consequential or economic loss or loss of profits and/or the acts or omissions of any third party) arising under or in connection with Membership, these AerClub Terms & Conditions and/or resulting from any alteration to, or termination of the AerClub programme and/or the right to earn or redeem Avios, and/or Tier status, Tier Credits and/or any of the Services.

21.2

Neither Aer Lingus nor AGL will be liable for any Loss if, by reason of local legal or regulatory prohibitions or restrictions, AerClub or the whole or any part of the Services cannot be made available in certain countries or to certain Members.

21.3

The limitations and exclusions of liability referred to in the Aer Lingus General Conditions of Carriage (https://www.aerlingus.com/support/legal/conditions-of-carriage/) will apply in relation to travel on the services of Aer Lingus including Reward travel.

21.4

The limitations and exclusions of liability referred to in terms and conditions and conditions of carriage and/or conditions of contract of the relevant AerClub Airline Partner will apply in relation to any travel on the services of the AerClub Airline Partner including Reward travel.

21.5

The limitations and exclusions of liability referred to in terms and conditions of Aer Lingus and/or AGL and the relevant Service Partner will apply to Non-Flight Rewards as are notified to the Member at the time of booking by Aer Lingus or the relevant Service Partner.


22. Member's tax liabilities

22.1

Neither Aer Lingus nor AGL makes any representations as to any income, use, excise or other tax liability of Members as a result of their Membership. Such a tax liability may arise, for example, if a Member obtains Avios and/or Rewards as a result of business expenditure. Members are advised to check with their accountant or tax adviser for further information.

22.2

The Member is solely responsible for any tax liability incurred as a result of Membership.


23. Governing Law

23.1

To the extent permissible by local law, these AerClub Terms and Conditions shall be governed by Irish law. Aer Lingus and each Member of AerClub submits to the non-exclusive jurisdiction of the Irish courts to resolve any disputes that may arise out of them.

23.2

Any provision of these AerClub Terms and Conditions declared void or unenforceable by any competent authority or court shall, to the extent of such invalidity or unenforceability, be deemed severable and shall not affect the other provisions remaining which shall continue unaffected.

23.3

If there is any conflict in meaning between the English language version of these AerClub Terms and Conditions and any version or translation of these AerClub Terms and Conditions in any other language, the English language version shall prevail.
